What is a dual occupancy?

A dual occupancy is two separate dwellings on a single lot of land. They can be attached – sharing a common wall, often called a duplex – or detached, where two independent homes sit on the same block.

It’s different from a secondary dwelling, or granny flat, which is a smaller home that sits secondary to a main residence. With a dual occupancy, both homes are designed as complete, standalone dwellings – and depending on your block and zoning, they may be able to be subdivided and sold or rented separately.

Can you build a dual occupancy on your block?

Recent changes to NSW planning have made dual occupancies possible in many more locations. Under the state government’s Low and Mid-Rise Housing reforms, dual occupancies are now permitted with council consent in low-density residential (R2) zones across NSW – including throughout the Central Coast, Lake Macquarie and Newcastle.

What you can actually build still depends on your block: its size, shape, zoning and your local council’s controls all play a part, and things like minimum lot sizes and setbacks vary from one area to the next.

What's the difference between a dual occupancy and a duplex?

A duplex is one type of dual occupancy – two attached homes sharing a common wall. “Dual occupancy” is the broader planning term, covering both attached homes (duplexes) and two detached homes on the one lot.
